Section 6: Rules for Driveways and Parking Areas
This section outlines the regulations for creating driveways and parking areas, as established by the Curb Cut Ordinance Article 8-13 R.O.A. 1994.
Residential Driveway Rules
These rules apply to requests to create driveways for single-family homes, townhouses, and duplexes with their own individual lots.
For single-family homes, driveways cannot directly access busy roads like major streets or collector streets. It’s also not recommended to have direct access to major local streets.
The width of a driveway can typically be between 12 to 22 feet, but there are exceptions. For example, if you have a three-car garage or need to park a recreational vehicle or boat off the street, you might be allowed a wider driveway, up to 30 feet. However, you need to prove these exceptions are necessary.
Shared Driveways
In some cases, multiple properties might share a driveway. The total width of these shared driveways can be up to 40 feet. Before creating a shared driveway, both property owners need to agree and sign a letter confirming their consent.
Townhouses
For very small lots (less than 40 feet wide), it’s recommended to have shared driveways between two lots, leaving some space for on-street parking.
There should be a minimum distance of 22 feet between two driveways on one lot, measured from the full height curb. This accounts for the transition between curb heights and ensures enough space between driveways.
The minimum distance from the property line for driveways, excluding shared driveways, is normally 5 and a half feet. This includes 3 feet for the curb transition and 2 and a half feet of separation to the property line. However, this distance can be reduced to 3 feet if both the adjacent property owner agrees and if the adjacent lot’s driveway is on the opposite side of the lot.
